In 2017, our charities team carried out a significant thought leadership project by commissioning a survey exploring the relationship between charities and probate practitioners when communicating about charitable legacies. The results of the survey were published in a 2017 report entitled ‘Bridging the Gap’.

Given the strength of the survey results, we hosted a conference (The Legacy Conversation) in March 2018, supported by ILM, STEP, IOF, The Probate Section of the Law Society and Remember a Charity.

This event brought together practitioners, legacy managers, regulatory bodies, and policy-makers, with a view to discussing some of the key issues raised in the survey. These included tensions arising out of legacy-related communications, the level of understanding of charity law in private practice, and a lack of consistency between charities. Speakers included representatives from the Office for Civil Society; the Charity Commission; and senior charity managers.

The event drew out several practical solutions which, once implemented, could assist both groups in better understanding each other's perspective, as well as increasing collaboration between charities. The general consensus was that this could greatly improve policy and practice within the sector, which would, in turn, have a positive impact upon the level of charitable income received.
